Pure Wallet Terms of Service

These terms (hereinafter referred to as the "Agreement") set forth the general terms and conditions for using the PureWallet.ai website (hereinafter referred to as the "Website" or "Service") and related products and services (collectively, the "Services"). Before using our Services, please carefully read these Terms of Service along with other policies and notices posted on our Website or mobile application.

1. Agreement to Terms
These Terms of Service apply when you access and use https://purewallet.ai and the mobile application, Pure Wallet (hereinafter referred to as the Website and the App). By using the Website or the App, you are deemed to have agreed to the entirety of these Terms. If you do not agree to these Terms, you may not use the services of PureWallet. These Terms include an arbitration clause and a class action waiver for dispute resolution. These provisions may affect your legal rights, so please review them carefully.
2. Changes to Terms
Pure Wallet reserves the right to modify these Terms at any time. If changes occur, users can review the updated Terms through the Website or App, and if necessary, will receive notifications via email. Unless otherwise stated, the revised Terms take effect immediately upon posting.
3. Links to Other Resources
The Website and Services may contain links to other resources, such as websites and mobile applications. However, unless explicitly stated otherwise, such links do not imply any endorsement, affiliation, sponsorship, or partnership with the linked resources.
4. Rules for Using the Service
When using the Pure Wallet service, you must comply with all applicable laws, including local, national, and international regulations.
- You must be of legal age (at least 18 years old) and have the legal capacity to enter into a binding contract.
- You must not be a resident of a country subject to international trade sanctions (e.g., those restricted by United Nations Security Council Resolutions (UNSCR) or the UK HM Treasury's financial sanctions regime).
- You must not be subject to economic sanctions (e.g., included in the UNSC Sanctions List, the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) List, the U.S. Department of Commerce's Denied Persons List, or any other relevant sanction lists).
If you are using the Service on behalf of a legal entity:
- The entity must be legally organized and validly existing under applicable laws.
- You must have the proper authority to act on behalf of the entity.
- The use of the Service must not be illegal in your jurisdiction.
- All transactions conducted through Pure Wallet must involve legally obtained funds.
- You must not engage in activities that impose excessive system load.
- You must not distribute malicious code or viruses within the Service.
Additional Terms
By using Pure Wallet, you certify that you meet the above eligibility requirements. Pure Wallet reserves the right to deny access to specific users and modify eligibility criteria at any time. While Pure Wallet does not monitor user content, it reserves the right to restrict or terminate service use without prior notice if a violation of these Terms is discovered. You acknowledge that while using this Service, you may be exposed to content that you find offensive or inappropriate, and Pure Wallet is not responsible for such exposure. Furthermore, any use of the Service in a manner not explicitly permitted by these Terms is strictly prohibited, and Pure Wallet may terminate your access to the Service without prior notice.
5. Service Overview
Pure Wallet is a non-custodial, decentralized cryptocurrency wallet that offers the following features:
- Secure storage, sending, and receiving of digital assets
- Browsing and accessing third-party decentralized applications (DApps) and decentralized exchanges (DEXs) via a web browser
- Exchanging and trading digital assets through DApps provided by third-party service providers
- Supporting swaps and trades between digital assets
- Providing real-time market price information for digital assets
- Facilitating blockchain transaction processing
PureWallet does not store users' private keys and therefore does not offer any recovery features. You are solely responsible for securely storing your wallet access information.
6. Wallet Address, Private Key, and Backup Features
Encrypted backups of certain wallet-related information may be stored on eligible devices. The private key is linked to the wallet address and is used to send or receive digital assets associated with that wallet address.
- You are solely responsible for safeguarding and securely storing your private key and all wallet-related recovery phrases ('Secret Phrase').
- It is crucial to back up your private key, backup phrase, or password—failure to do so may result in the loss of control over your digital assets associated with the wallet.
- You acknowledge and agree that Pure Wallet does not receive or store your wallet password, encrypted private key, unencrypted private key, or any Secret Phrase related to your wallet.
- If you forget your original password, you will not be able to generate a new one to access the wallet.
- If you fail to securely store a backup of your wallet address and private key pair, you accept and acknowledge that you will be permanently unable to access the digital assets linked to that wallet address.
- Therefore, if you lose access to your wallet for any reason—including failure to securely store your wallet address, Secret Phrase, or private key—Pure Wallet bears no responsibility for any resulting loss.
7. Use of DApps and DEX
When using the built-in DApp features and decentralized exchanges (DEX) within Pure Wallet, you acknowledge and agree to the following:
- Pure Wallet assumes no responsibility for your use of DApps and DEXs.
- PureWallet.ai does not guarantee access to or the functionality of any DApp or DEX, and any issues arising from their use are solely your responsibility.
- Transaction limits on DEXs are subject to the constraints of third-party smart contracts.
- These limits are determined by the structure of the smart contract you choose and the requirements of the respective blockchain network.
- Transactions executed on the blockchain are irreversible.
- Any transaction conducted via DApps or DEXs cannot be undone, and you are responsible for any consequences resulting from transaction errors (e.g., incorrect address entry or issues with the selected node).
- Pure Wallet does not guarantee or control transaction fees associated with DApps and DEXs.
- Third-party smart contracts may impose additional fees and service charges, which are provided as informational references only.
- Pure Wallet does not ensure the accuracy, applicability, reliability, or appropriateness of these fees, and you bear full responsibility for them.
- Pure Wallet does not currently charge any service fees for DApp and DEX usage.
- However, Pure Wallet reserves the right to introduce service fees at its discretion in the future. Any new fee policies will apply only to transactions conducted after the effective date.
8. Use of Offline Wallet Functionality
By using Pure Wallet's offline wallet feature, you acknowledge and agree to the following:
- Pure Wallet allows transactions without an internet connection by utilizing Bluetooth, NFC, QR codes, and Wi-Fi for digital asset transfers.
- Offline transactions may be executed without gas fees, but additional requirements may apply depending on the network or transaction method.
- Pure Wallet is not responsible for any errors or delays that may occur when offline transactions are reflected on the blockchain network.
- Offline wallets interact with blockchain networks and smart contracts, and changes to these networks or contract updates may impact wallet functionality.
- Pure Wallet is not liable for any issues caused by blockchain network modifications or errors in smart contracts.
- You are solely responsible for verifying the accuracy and legality of all transactions made in offline mode.
9. Use of Cold Wallet Functionality
By using Pure Wallet's cold wallet feature, you acknowledge and agree to the following:
- Cold wallets operate in a fully offline environment, ensuring the protection of digital assets by isolating them from the internet.
- Pure Wallet does not store your private key or recovery phrase, and you are responsible for any asset loss due to mishandling of this information.
- Cold wallets interact with blockchain networks and smart contracts, and changes to these networks or contract updates may impact wallet functionality.
- Pure Wallet is not liable for any issues caused by blockchain network modifications or errors in smart contracts.
- Users must comply with any regulations required by specific blockchain networks when using a cold wallet.
- You are fully responsible for implementing and understanding all security measures necessary to protect digital assets using a cold wallet.
10. Limitation of Liability & Disclaimer of Warranties
You acknowledge and agree to the following:
- Pure Wallet is not responsible for any errors, delays, or failures that may occur during the processing of digital asset transactions.
- Users bear full responsibility for risks related to hardware, software, and internet connectivity failures or losses.
- Pure Wallet is not liable for any losses caused by malicious software, including viruses, phishing attacks, or hacking.
- Pure Wallet assumes no responsibility for any losses resulting from unauthorized access by third parties to your wallet address, private key, or secret phrase.
- Pure Wallet is not liable for losses arising from unforeseen changes in blockchain networks or unknown vulnerabilities.
Limitation of Liability
To the maximum extent permitted by applicable law, Pure Wallet, its affiliates, directors, officers, employees, agents, suppliers, and contractors shall not be liable for any of the following:
- Loss of data, information, revenue, profits, or any other business or financial losses
- Unauthorized access due to the user's negligence in managing their secret phrase or private key
- Losses resulting from the user's own errors while using Pure Wallet services
- Service disruptions caused by failures in public infrastructure or internet connectivity issues
Disclaimer of Warranties
Pure Wallet makes no warranties of any kind:
- Disclaims all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Does not guarantee that the service will always be uninterrupted, error-free, or accurate.
Some jurisdictions may not allow the exclusion of implied warranties, so certain provisions may not apply to you.
11. Arbitration & Class Action Waiver
You and PureWallet agree to resolve all disputes related to this agreement or the use of the service through individual arbitration. By agreeing to arbitration, you waive your right to file a lawsuit in court or have a trial by jury.
- All arbitration proceedings will take place in the State of Texas, USA, and will be conducted confidentially in accordance with the rules of the designated arbitration institution.
- The arbitrator has the authority to grant any remedies that a court could provide.
- The arbitration process may be conducted based on written submissions, with in-person hearings held only if necessary.
- The prevailing party in arbitration may seek reimbursement for attorney's fees and other costs from the opposing party.
- You and PureWallet agree that no class actions or class arbitration procedures shall be initiated under any circumstances.
12. Limitation on Claims
You agree that any claim arising from or related to your relationship with Pure Wallet must be filed within one (1) year from the date the claim arises. Failure to do so will result in the claim being permanently barred.
13. Force Majeure Clause
Pure Wallet shall not be liable for any delays, disruptions, or inability to perform services due to events beyond its reasonable control, including but not limited to:
- Civil or industrial disturbances, war, strikes, or other labor disputes
- Natural disasters (e.g., fires, earthquakes, storms)
- Disruptions in internet service or network providers
- Hardware or software failures, defects in smart contracts
- Changes to blockchain network protocols or other unforeseen events
If such force majeure events prevent Pure Wallet from fulfilling its obligations under these Terms, Pure Wallet shall not be held responsible for the duration of the event.
